    4. Except where mandated by the relevant legislation, it is hereby specified that the fees for Products are non-refundable due to their tailor-made character. However, in the case of gemmological educational services, refunds are available upon receipt of a 24-hour prior notice.

It is important to note that we cannot accept liability or responsibility for any problems that may arise with your jewellery if the advice and instructions provided have not been precisely followed. Therefore, we strongly encourage you to take the time to carefully read and understand the information provided to ensure the longevity and continued beauty of your jewellery.

You agree, to the extent permissible under Applicable Laws, to indemnify, defend, and hold harmless Harle Paris, and its successors, affiliated companies, contractors, officers, directors, employees, agents and its third-party suppliers, licensors, and partners (“Harle Paris Parties") from and against all losses, damages, liabilities, demands, judgements, settlements, costs and expenses of any kind (including legal fees and expenses), from any claim or demand made by any third-party relating to or arising out of (i) your access to, use or misuse of the Website (ii) your breach or alleged breach of these Terms, or any violation of the Terms; (iii) any breach of the representations, warranties, and covenants made herein; (iv) your failure to comply with Applicable Laws (including any failure to obtain or provide any necessary consent or notice); or, (v) the infringement by you of any intellectual property, privacy, or other right of any person or entity, including in connection with your User Content

You assume the exclusive defence and control of any matter for which you are required to indemnify Harle Paris, and you agree to cooperate with Harle Paris’ defence of these claims.  You agree not to settle any such matter without the prior written consent of Harle Paris. Harle Paris will use reasonable efforts to notify you of any such claim, action, or proceeding upon becoming aware of it.
  1. LIMITATION OF LIABILITY

IN NO EVENT SHALL WE (AND OUR AFFILIATES) BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY LOST PROFIT OR ANY INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL OR PUNITIVE DAMAGES ARISING FROM THESE TERMS OR YOUR USE OF, OR INABILITY TO USE, THE SERVICE, OR THIRD-PARTY ADS, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. NOTWITHSTANDING ANYTHING TO THE CONTRARY CONTAINED HEREIN, YOU AGREE THAT THE AGGREGATE LIABILITY OF HARLE PARIS TO YOU FOR ANY AND ALL CLAIMS ARISING FROM THE USE OF THE SERVICE, CONTENT OF ANNOUNCEMENTS, IS LIMITED TO THE LESSER OF THE AMOUNTS YOU HAVE PAID, IF ANY, TO US FOR A PRODUCT OR SERVICE.
  1. INTELLECTUAL PROPERTY RIGHTS

Information you submit to us as part of your communication with us, feedback you give to us, and any other materials that you may submit or post on the Website (the “User Content”) remain your intellectual property, and Harle Paris does not claim any ownership of the copyright or other proprietary intellectual property rights in such information and the User Content.   1. GOVERNING LAW AND JURISDICTION
    1. These Terms shall be governed in accordance with the laws of England and Wales, without giving effect to any principles of conflicts of law that would cause the application of the laws of any other jurisdiction.
    2. Any dispute, controversy or claim arising out of or in connection to these Terms, or breach, termination or invalidity thereof shall be settled by Arbitration in accordance with the rules of the London Court of International Arbitration (LCIA). The language to be used in the arbitral proceedings shall be English and the seat of the arbitration shall be London.
    3. If any party is dissatisfied with the arbitrator’s award, they shall have the right to litigate.
    4. Harle Paris and you agree to submit to the exclusive jurisdiction of the English and Welsh courts, but if you are a consumer and you live in Scotland, Northern Ireland or the Republic of Ireland, the courts of those jurisdictions shall also have jurisdiction in relation to any dispute about these Terms.
  1. INTERNATIONAL USE

    Harle Paris is based in the United Kingdom and offers international shipping to selected countries. By placing an order from outside the United Kingdom, you acknowledge and agree that:

    1. Duties, Taxes & Import Charges:
      International orders are shipped DDU (Delivered Duty Unpaid). Customers are responsible for any import VAT, customs duties, handling fees, local taxes, or other charges applied by the destination country. These costs are not included in the checkout total and are payable upon delivery.

    2. Compliance with Local Laws:
      You are solely responsible for ensuring that your access to the Website and your purchase of our Products complies with all local laws, regulations, and restrictions applicable in your jurisdiction. We do not guarantee that the Website, its content, or our Products are appropriate, permitted, or lawful for use outside the United Kingdom.

    3. Jurisdiction of Website Operations:
      Harle Paris operates the Website from the United Kingdom. By accessing the Website from outside the UK, you consent to the processing, transmission, and storage of your data in the United Kingdom, and you acknowledge that data protection standards in your jurisdiction may differ.

    4. International Restrictions:
      Harle Paris reserves the right to refuse or cancel any international order where shipping services are unavailable, restricted, unsafe, or where customs regulations prohibit or complicate the delivery of jewellery or precious materials.

    5. Shipping, Delays & Non-Delivery:
      International deliveries may be subject to delays due to customs inspection, local postal processes, or other factors beyond our control. Harle Paris is not responsible for delays, refusal of entry, or returned items caused by customs authorities or local regulations. Additional costs for reshipment due to incorrect addresses or refusal to pay duties are the responsibility of the customer.

    6. Limitations on Legal Remedies:
      Unless expressly required by consumer protection laws applicable in your jurisdiction, Harle Paris does not represent that legal remedies, service guarantees, or statutory protections available in the United Kingdom apply outside the UK. Your statutory rights in your country of residence may vary.

  1. Term and Termination

These Terms shall remain in full force and effect while you use the Website unless they are terminated as provided in these Terms, in which case you no longer have the right to use the Website.

  1. Termination by Harle Paris

Harle Paris may, in its sole discretion, and at any time discontinue providing access to the Website, or any part thereof, with or without notice.  You agree that any termination of your access to the Website, or portion thereof, may be affected without prior notice, and you agree that we will not be liable to you or any third party for any such termination. Any suspected fraudulent, abusive or illegal activity may be referred to appropriate law enforcement authorities. These remedies are in addition to any other remedies we may have at law or in equity. As discussed herein, Harle Paris does not permit copyright, trademarks, or other intellectual property infringing activities on the Website, and will terminate access to the Website, and remove all User Content or other content submitted, by any Users who are found to be repeat infringers.

  4. In no event shall Harle Paris be liable for any failure to comply with these Terms to the extent that such failure arises from factors outside Harle Paris’s reasonable control.
